Terms and conditions of sale


The General Terms and Conditions are drawn up in accordance with consumer protection regulations, based on the recommendations of the Slovenian Chamber of Commerce and Industry and international codes for online and electronic business. Fenzy (hereinafter referred to as "online store") is operated by INTEKO DOO, an e-commerce operator (hereinafter referred to as "the merchant").

By purchasing or subscribing to Fenzy, the consumer allows the merchant to: store, process and use personal information transmitted through a web form (until canceled) for the following purposes: offer goods, services, phone calls, SMS, email or other means of telecommunication (hereinafter: direct marketing), surveys, statistical processing.

An individual may, at any time (in writing or otherwise agreed), require the controller to permanently or temporarily suspend the use of their personal data for direct marketing purposes.

These General Terms and Conditions define the operation of the online store, the rights and duties of the visitor, the user and the buyer, and the business relationship between the merchant and the user as a consumer of products from the online store.

2. Information accessibility

The trader undertakes to always be available to the user:

  • Information on the identity of the trader (in particular, the company and its registered office and the registration number in which the company is registered);

  • Contact information that allows the user to communicate quickly and efficiently with the merchant (email address, telephone, etc.);

  • Information about the essential characteristics of the services that an online store offers, including after-sales services and guarantees;

  • Information about the availability of the product or services of an online store offering; form and conditions of delivery of the products or the provision of services, in particular the place and time of delivery;

  • Information about the payment method;

  • Information on the period within which it is still possible to withdraw the contract and the withdrawal conditions;

  • Information about the possibility of returning items, as well as how much such a refund will cost the user;

  • Information about the user complaint process and information about the contact with the client and the point of contact.

3 . Security of personal data

The merchant uses appropriate technological and organizational means to protect the transmission and storage of personal data and payments.

Authorized online systems are responsible for secure authorizations and credit card transactions. Credit card authorizations are executed in real time with immediate verification of the data in the banks. Card information is not stored on the merchant's server.

For security, the user is also responsible for ensuring the security of his username and password and for adequate software and antivirus protection of his computer.

3.1. Collection of personal data:

  • when ordering in the online shop: name, surname, address, mobile phone, email

  • when ordering via cell phone: name, surname, address, mobile phone, email

  • In relation to the surveys on the fenzy.be website, the user may, at his discretion, provide additional data such as date of birth, gender, age, body measurements, etc.

  • In order to place orders, Fenzy may respond to users through email, mail, telephone, chat rooms, etc. and collect the following data: name, surname, date of birth, gender, email, delivery address, mobile phone and body measurements

3.2. Collection of non-personal data

  • each time you access the Fenzy.be website, non-personal data such as number of hits to the website, time of access, items viewed, etc., are recorded automatically (not as part of the log). The information is used for company statistics and to improve the content and security of the page.

  • The user can prevent the collection of non-personal data through cookies with the use of appropriate settings in his Internet browser.

  • When the user is not registered, non-personal data is also collected by services such as Google Analytics, Iprom, AdServer, etc. that install the cookie on the user's computer.   • By using the Fenzy Facebook and Fenzy Instagram pages, voluntarily posting on the Fenzy Facebook and Fenzy Instagram pages and adding your photos and video content You consent to the Fenzy page administrator (Inteko doo, Slap 3e, 5271 Vipava) using your content published for advertising purposes on other Fenzy pages within the group, various advertising campaigns and communication with other users of the Fenzy Facebook and Instagram pages.

4 . Protection of minors

An online store merchant will not accept orders from someone known or suspected to be a minor, without the express permission of their parent or guardian.

Without the explicit permission of the parent or guardian, the merchant will not accept any personal data concerning minors, nor will it issue the information received from them to third parties other than their parents or guardians.

5 . Responsibility

The merchant makes every effort to ensure the updating and correctness of the information published in its online store, however; product properties, delivery times or prices may change so quickly that the merchant will sometimes not be able to correct the data published in the online store in a timely manner. In such case, the merchant will notify you of the change and allow you to withdraw from the order or change the order.

Although the merchant tries to provide exact photos of the items available in his online store, all photos must be taken as symbolic. Photos do not offer product features.

6 . Purchase in the online store and the conditions of purchase

Due to the nature of online shopping, the online store's product offerings often and rapidly change and are updated. Therefore, errors may occur, if this happens to you, please let us know at info@fenzy.be. We will therefore try to resolve any situation as soon as possible.

6.1. Delivery term

The delivery time of the goods available in the warehouse is usually 7 to 8 business days for delivery addresses Belgium. All items in the online store are accessible within a reasonable time.

6.2. collect products

The customer can also settle his purchase with the cash on delivery method through GLS; This means that the customer agrees to have cash with him at the time the courier shows up at the address that the customer has provided and on the day and time specified (prior agreement with the distributor via email).

There is also the option of delivering by DHL Express which costs €21.90 . Orders, received until 1:00 p.m. on working days, will be dispatched the same day and delivered in 1-2 working days . Delivery is not made on Saturdays, Sundays and holidays .

DHL EXPRESS DELIVERY ALWAYS CARRIES THE COST. In the case of the exchange of items ordered with the DHL Express service, we will send the exchanges with the standard delivery (GLS).

6.3 . payment modalities

Shipping is free . The merchant provides the following forms of payment for the purchase of products from the online store:

  • Payment by credit card (Maestro, Eurocard / Mastercard, Visa)

  • PayPal.
  • With pro forma invoice in the merchant's bank account.

6.4 . Prices

All prices in the online store are shown in euros and include VAT, unless explicitly stated otherwise. All prices shown in the store are the prices of the products, which do not include shipping costs (see points 3 and 10). All prices are applied at the time of award of the contract and do not have a predefined validity, so they only apply to their respective changes.

6.5. Code

  • discount code

Discount code provides several advantages when shopping through the Fenzy.be online store and has a limited validity. The code is acquired by being a new buyer, through e-notifications, SMS messages or other means. The code can be issued in the form of a discount percentage or a fixed amount. The code cannot be redeemed for cash.

  • subscription code

The client receives the subscription code in the event of withdrawal from the contract and instead of the refund in his bank account, he chooses the unique code of the subscription for the value of the executed purchase. The customer can use this code on the next purchase, or on subsequent purchases if it has not been used in its entirety on the first purchase. The customer has the right to redeem the code for cash.

6. 6. Purchase procedure

6.6.1. order accepted

When placing the order, the user (customer) receives from the merchant by email a notice that the order has been accepted. The user has the right to cancel the order and to change its content through the email info@fenzy.be , messenger or telephone .

6.6.2. Confirmed order

If the user (client) does not cancel the order, the order will be processed later. Upon receipt of the order, the merchant checks the availability of the ordered products and confirms the order or rejects it for any reason. The merchant can also contact the user (customer) through a contact telephone number to verify the data or to guarantee delivery. After confirmation of the order, the distributor (GLS) will inform by email the expected date of delivery.

6.6.3. shipped goods

The merchant will prepare the ordered products so that the distributor (GLS) takes care of their delivery within the agreed period.

6.7 . purchase contract

The merchant will issue an invoice to the user who makes a purchase of any of our products from the online store with a breakdown of the costs and an explanation of the right to withdraw from the purchase by returning the purchased product under the specified conditions (see point 10 ). The purchase contract is concluded in Spanish.

The sales contract between the merchant and the user (customer) is concluded at the moment the merchant confirms the order (see point 6.5.2). From this moment on, all prices and other purchase conditions are fixed and apply to both the merchant and the user (customer).

We try to create the best shopping experience for you, but we are aware that sometimes there is a situation where the item does not fit you and you have to exchange it, return it or make a claim.

You can replace, return or make a complaint for your order within 14 days after receiving the package.

In case of exchange or return, the item must be in the conditions in which you received it.
The item must be returned unworn and washed in its original packaging with all applicable tags. Otherwise, we reserve the right to refuse such return in accordance with our terms of business.

For hygiene and health reasons, returns of the following items are limited:

- We do not accept returns of earrings

- The swimsuit can only be returned if the protection sheet has not been removed.

- Shoes can only be put indoors

If the item received does not correspond to your size, you have the option to exchange the item for a larger / smaller size or for any other item on our website www.fenzy.be .

The item you want to exchange can be returned within 14 days after receipt of the package.

If you are not satisfied with the item received and you do not wish to receive the exchange at the moment, you can choose the item value / returned items voucher option , which you can use for your next purchase.

To get the voucher, fill in the "I want to receive the voucher" field on the Exchange Form . You will receive the voucher by email.

If you have received the wrong or damaged item, we apologize. We will resolve your complaint as soon as possible.

In case your order does not fit you and you have decided on a refund, you can return it to our address through any delivery service.

Unfortunately, we DO NOT cover the cost of returning your order, so we recommend that you choose the cheapest delivery option with the package tracking option.

We DO NOT accept return shipments with cash on delivery.

Do not select an untracked service and keep proof of shipment with the package tracking number until we refund your purchase price.

If you are returning items from two or more different orders, be sure to write the numbers for all returned orders on the return form.

We will refund your purchase price within 14 working days after receipt of the package at our main warehouse in Slovenia.

If you paid for your package with cash on delivery or credit card, write the exact IBAN account (see IBAN example below) and the information about the owner of the account on the return form attached to the package (first name, last name and address of the account owner).

In case the IBAN provided is incorrect, the refund process may be extended.

The cost of the bank transaction in case of reimbursement is covered by Inteko doo and is free for you.

If you provide us with an incorrect IBAN, the customer will be charged the costs of the new transaction (5 €) when making the transfer again. Thanks for your understanding.

6.9 . Delivery

The merchant will deliver the products ordered by the user (client) within the agreed time, the merchant's distribution partner is GLS.

In case of visible damage to the packaging or the goods, the customer's claim must be made to the dealer (to the delivery service) upon receipt of the goods. The buyer of said goods is not obliged to accept and may refuse the shipment in the event that the packaging is physically damaged, shows lack of contents or signs of opening, or if the products are damaged in the packaging; In the event that the buyer has accepted the package, the buyer must initiate the claim procedure directly with the dealer.


When the customer places the order through the page www.fenzy.be, they automatically agree to comply with all the purchase conditions. At the end of the order, the customer agrees to receive and pay the full amount of the order (see General Conditions, article 6.2.). The customer can cancel the purchase and sale contract only in case of prior notice by email or telephone (General Conditions, article 6.6.1 and 6.6.2) before his order enters the delivery process. In the event that the order is already in delivery or in the dealer's store and the customer violates the contract by refusing or not accepting the order without prior cancellation, the seller (Fenzy Clothing Store) has every right to demand a refund. €20 which includes packaging, shipping and return costs. In case of not returning the money within 8 days after receiving the notice, the seller can start demanding the refund of the amount through legal channels.

7 . Claims, litigation and law enforcement

The merchant respects the applicable consumer protection regulations, likewise, has an effective complaint handling system and has a person who, in the event of a problem, can contact the user (customer) by email, or in cases extraordinary over the phone. In case of problems, the user (client) can always contact us through our email: info@fenzy.be. The complaint handling procedure is confidential.

Within 5 working days, the merchant will confirm that it has received a complaint and has informed the user (customer) of the approximate time for the resolution of the complaint and will keep him informed about the progress of the procedure. Merchant will endeavor to best resolve any dispute by mutual consent. If an amicable settlement of the dispute is not reached, the Ljubljana court will have exclusive jurisdiction to resolve any dispute between the trader and the user (customer). The merchant and the customer, as a participant in electronic commerce, mutually acknowledge the validity of electronic messages in court.

These General Terms and Conditions and all disputes between the trader and the user (client) are subject to Slovenian substantive and procedural law, without applying the rules of private international law indicating the use of any other law.

For all relationships, rights and obligations that are not governed by these General Conditions, the provisions of the Mandatory Code, the Electronic Commerce Law, the Personal Data Protection Law and the Consumer Protection Law will apply.

8 . Modifications of the general conditions of the business

The user who does not agree with the amendments and / or modifications to these General Conditions must revoke their registration within a period of eight days from the announcement of the modification and / or modification of the General Conditions of Business; Otherwise, the expiration date will be counted and evidence to the contrary will not be accepted. The cancellation of a registration must be made in writing by the user to the merchant.
